May kalokohan pa silang law firm eh di naman attorney ung sumulat sakin. Kaya ung mga nakatanggap ng letter mula sa kanila, wag kayong matakot malibanna lang kung magpapadala kayo.

Wala din kasing kwenta dole, nbi o kung ano mang ahensya ng gobyerno ntin kaya nga nasa ibabaw pa ng mundo yang kumpanyang iyan. Palibhasa kasi nasa listahan sila ng payroll ni JEA.

haha.. nag apply din ako sakanila last march.. contract signing na ako sakanila nung biglang mamulat saakin ang katotohanan.

UNA.. wala silang professionalism... biruin mo tawagan ka banaman nang 9:00AM para sabihin sayo na may final interview ka nang 12:00PM on the same day at saturday pa. ayos din sila diba...

PANGALAWA.. yung employee handbook nila na 2 page short bond paper lang at mukang kapanahunan pa nang lola ko na print sa luma.. biruin mo handbook nila puro grammatical errors pa... AS IN!!!!.. anong company ang seseryosohin mo kung yung mismong employee handbook nila eh puro wrong grammar.. tapos ang pangit pa nang benefits mo, halos wala nga eh.hahaha..

PANGATLO at PANGHULI.. biruin mo dun sa 9.5K na base salary mo eh d pa yun nakakaltasan nang tax at ibang deductions (sss, philhealth etc etc). at ang napakagandang dahilan pa nila kung bkt d sila nagtatangal nang tax eh d naman daw kailangan yun, kasi lahat naman daw nang binibili natin ay may recibo thus may tax.. HALLERRR!!!!! basta may income ka may tax kang babayaran.. kaya nga INCOME TAX EH!!!! ano sila tax exempted?? huling tingin ko hindi naman sila religious, school or charitable institution ah. parang gusto ko tawagan si prof. Llave yung prof namin sa TAX para parangalan sila 2ngkol dun.. makakasuhan pa ako nang tax evasion dahl sakanila. ampf...

kaya sa aking mga kababayan.. wag maging padalos dalos sa paghahanap nang trabaho. kahit mahirap makahanap nito eh dapat maging mapili pa rin.. sige ka ikaw din ang magsisisi...

P.S:

Disadvantages:
75K bond nila for 16 months.. pag lumayas ka w/in 16months eh magbabayad ka nang 75K for damages.. tapos may 10K kaltas ka for 6 months sa sweldo mo.. makukuha mo sxa after 16 months.. yan daw ang backpay... PUTANG INANG BACKPAY YAN!!! EH NANGGALING DIN SA SWELDO MO EH!

ako simple lang sagot ko dyan i applied for the company minsan ako nagkasakit inakala nila na awol na ako but i still came to there office asking for there excuse for my swelling right chick... on that same day was the day of my salary i did not even got my salary that day, coz they where hiding from me... before i got sick i ask my mom to actually call the company and ask for an excuse payag na ako bawasan ang sahod ko aslong as makapagpahinga ako coz i cant work that day... but still i go personally on the office asking for there permission and asking for my salary to pay for my medication... but still they said "3 days before your will get my salary"... they delayed my salary... so the next day i tried to go to office wearing a Mask even thou i'm not feeling well just to get my salary back to me... My moral was down that day coz i had no money and i just barrowed 50 php just to get to office...my moral was down i can't even work good... but still i had to work because its in the contract that even sick if you dont go to work u will be deducted... then i got tired and got more absences because my moral was down still i tried to work... until that day they pass to me a memo telling me to have a 3 day suspension... i did'nt go back... because of the damage they do to me making my moral down as an employee... yes i signed for your contract and honestly they know this that i work hard for the position they gave to me... that's why i gained your trust and earned additional salaries in your company for just my 1st month working in your company ...but with just one tragedy that came to me you treated me like i was just a lower class person ...
maraming taong nakakaalam ng situation ko after you did that to me... and when i was working on your comapany many ppl high class and low class person knew my situation but still i don't mind sabi nila balikan ko kayo... pero sa totoo lang pinapatawad ko naman kayo sa ginawa nyo and nagpapasalamat din ako sa ginawa nyo kc kung d nangyari sakin un mga yun d ko malalaman na i can still be strong kahit na meron na akong naging trials na ganun dati sa company ninyo...

hmm.. Nag apply ako sa kanila dati. May 10k cash ban nga sila tanda ko at may 16 months lock-in ka sa company. Kaya pala ang dami nila opening sa Phil-job.net ngaun. Apply sana ako e. Buti nkita ko tong blog na to.

Pero infairness kaya ko gusto magapply dun ulit kc dko makalimutan ung HR nila.. hehe ganda. kahit 1 beses ko lng cya nakita namimiss ko cya. :P

I am never a mere employee in that company, I am good AND yet I've been treated like nobody. With 13 salary (similar to fastfood crew salary) for 16months and an offering of 18k for a supervisory position (too low, 18k is an entry level salary), a proof that I've been cheated by the under wage salary. Without a single BENEFIT (without 'S').

Compare the company rules IF they conform to the Philippine's CODE OF LABOR (http://www.dole.gov.ph/labor_codes.php).

The 5% NIGHT DIFFERENTIAL PAY given by STRATVISIONS doesn't even conform with the CODE OF LABOR's minimum of 10%.

eto pa ma-late ka ng 3 beses kaltas na sahod mo my memo ka pa na 4 hours na trabaho walang bayad, depende pa yan sa dami ng late mo, pag naka jackpot ka isang buwan kang mag tatrabaho ng sabado walang bayad, at pag minalas-malas ka pa 8 oras sa loob ng 15 sabado kang mag tatrabaho as usual walng bayad, pag lalo ka pang minalas at na pagtripan ka pa nakow madadagdagan pa yan, sasabihin nakaapekto sa kompanya eh putsa double deduction ka na nga my memo ka pa, ano ng natira sa 4 thousand mo?

eto pa guys, naka kontrata ka ng 2 taon, yung increase sa sahod na sinasabi nila, wag mo ng asahan, perfect kaya ako sa 6 months probation ko pero kung kailan ako na regular dun pa bumaha ang memo, tapos walang increase sa sahod, pag nag AWOL ka hahabulin ka para sa 75 thousand Training fee at breach of contract. Tanong lang anong training? walang training, ang gagawin nila bibigyan ka ng intruction kung pano mo gagawin ang trabaho, at yung manual abay malamang natural lang na i-explain yun sayo dahil bago ka sa kompanya, pero wag ka TRAINING daw ang letche.

Kung napagtiisan mo naman ng 2 taon, makakakuha ka ng cash bond na 10k, sa hindi nakaka alam kung saan manggagaling yun, eto na, syempre sayo pa din, sa loob ng 6 na buwan kakaltasan yung sahod mo hanggang mabuo mo yung 10k. Kung sa ibang kompanya ang separation pay eh parang bonus para sayo, sa STRATVISION lahat pahirap sa empleyado.

Isip isip kayo guys, kung gusto nyo mag apply dito, i suggest wag na,maraming katiwalian ang kompanyang to, mas mabuti kung iwasan nyo, mag call center ka na lang.

Sa STRATVISION? wag nyong hintayin ang karma, mga Sir/Mam alam nyo kung gano katindi kapag bumawi si Lord kayo rin marami ang matutuwa.

strat is not expanding, in fact their employees take AWOL. why?

1. 10 hrs work without OT pay
2. consecutive salary delays
3. unfair management and staff

teka nag training ka na ba? kung oo, if ever my matanggap kang dulat na galing sa kanila wag na wag mong tatanggapin dahil peperahan ka lang.

I was hired as web designer nung 2008 dyan sa stratvision ang nangyari ang dami nilang rules at lahat ng nabasa nyo regarding sa cash bond at back pay na sayu din nangagaling etc. totoo yun isang araw lang ako Dyan dati di ko na tinuloy. kalokohan kasi yung mga rules nila. like pag umabsent ka kahit may sakit ka consider na absent at kaltas ka..walang benefits na SL or VL man lang. buti nalng talaga di ko tinuloy. Thank GOD.

The company named STRATVISION INC. has already changed their name to TECHNOSPEED INC. because "STRATVISION INC." is already notorious and well-known for its hellish company policies and rules...they're already having a hard time to get applicants that's why they changed their company name. HEHEHEHE applicants are now aware of what kind of company is this...

Ff. are what you will experience if you will work in this company:

1. 10 hours of working every day from Monday to Friday without being paid of your 2 hours overtime.

2. If you're absent for a day you will be required to render 4 hours make-up.

3. You can't use your SL and VL.

4. You will see that your bosses: Joel Aquino, David Aquino and Jun Ventura are all greedy for money they don't care whether you have serious illness. What's important for them is to have you working and working.

5. 2 times absent in a month are equivalent to excessive absent which are not allowed in the company. If you've committed 2 absences then you should expect suspension memo.

6. You cannot be absent on a Monday or Friday because it's also not allowed in the company. If you've committed an absent then you should also expect a suspension memo.

7. Late calling in the office before one hour of the start of the shift is also not allowed. 3 days suspension memo will be released to the employee who called late in the office.

8. Worst: you will experience if how to be a robot if you work in this company.

[edit]Formation of the group
The group formed in 2002 with 4 members of a group named Nansho Kids: Mako Sakurai, Izumi Nakadai, Tomoyo Matsumoto, and Ruri Mizutani (sister of a famous actress, Yuri Mizutani) and added Santos Anna (who appeared in a Japanese version of Annie) as a vocalist and debuted at Bandai display corner at the Tokyo Toy Show in May of the same year. Their unique style, 4 percussionists and 1 vocalist, attracted a lot of attention from media in Japan even before they debuted. With an average age of 14 at the time of debut, they were also gracing the cover of music magazines. In June of the same year, their official Website “B3 TV” was opened.

First single
On July 17, 2002, they released their first single “Ai want you!!”. The song was written by Paninaro 30 (lyric) and ex-Wands Kosuke Oshima (music). During July 24 to August 28, they performed weekly concerts at a live house named Harajuku Ruido. The low cost of the cover (500 yen including drinks, roughly 5 dollars USD), the completeness of the performance, as well as the word of mouth helped to fill the house consistently.
The quality of their music had been assured because one of Japanese major record labels, Being, has been supporting them since their debut. And as the members started to improve in terms of their percussion skills, their popularity also shot up. On December 26, they had a concert at Harajuku Ruido again, and this time the live house was sold out within the same day. The door of the live house wouldn't close due to the amount of audience.
During this period of time, a selection of songs were performed without instruments and was called "Dance Version". This was met with a decent amount of critics approval, labeling them as a dance unit. With the improved abilities of the members, the frequency of the "Dance Versions" of the songs decreased, and there have been fans that wish to bring some of the dancing back.

The turning point had come in 2004. Their 6th single, 'Bon Voyage' was used as a theme of a famous animation program, 'One Piece', and it became No. 8 at hit charts in Japan. And Bon-Bon Blanco's name finally was recognized by a lot of people. And with 7th single, 'Tenohira wo Taiyo ni', they visited a lot of elementary schools, including the school Anna graduated. This song is the 4th cover song of the group after 'Conga' from Miami Sound Machine and 'Come to me' from Bobby Caldwell, And 'Ureshii Tanoshii Daisuki' from Dreams Come True, all of which are included in their 2nd album, 'B3 masterpieces 2002–2004'.

Rise and Fall
However, after the hit of 'Bon Voyage', the gap between the group aiming at and what fans require was widened graduately, and the sales of copies of each single descended along with that. And after they released 'Ai ga ippai' in 2005, although the group was sometimes guested to some concerts including a musical named 'Angel Gate', they had to take a factual leave continued for one and half years.

On July 25, 2006, they had a concert at Shibuya Bpxx, and it was the beginning of their return. On August 30, they released 'Yura Yura Yureru', from a new record label set up by the producer of Bon-Bon Blanco, Bouncy Records.[1] This is the song they performed in Angel Gate. In this song, and they renewed the group's image changing their costumes from jeans and t-shirts to sexy bikinis. Anna challenged to rapping first time.
In 2007, the group started its activity from the concert held at Shibuya O-EAST on January 27. On February 21, they released their 11th single, '∞Changing∞. They had several free concerts in Akihabara from March to July. From July, they started monthly concert titled 'Onnna Matsuri'(女祭) at Shibuya O-West. On February 6, 2008, their first live DVD which includes this 'Onna Matsuri' was released.

Eugenio "Boy" Romerica Abunda, Jr. (born 29 October 1955) is a Filipino television host, publicist, talent manager and celebrity endorser.[1] He is dubbed as the "King of Talk" in local show business.

Early life

Boy Abunda was born in Borongan City, Eastern Samar.[3] He left college after his father's death and worked in odd jobs to support himself.[4]
He later worked as an assistant stage manager in the Metropolitan Theater. Eventually, he became the assistant of Conchita "Tita Conching" Sunico, who was the administrator of the theater at that time.[1] She taught him about public relations and within a couple of years, he started Backroom, Inc., a public relations firm.[3] He was working as a public relations consultant for the GMA Network when Bobby Barreiro, a network executive, suggested to him to try hosting a television show.
Abunda became a host of Show and Tell, a late night variety talk show with Gretchen Barretto, and Startalk, an entertainment talk show. BB Gandanghari (born Rustom Cariño Padilla on 4 September 1967)[1] is a Filipino transsexual actress and commercial model. She is the elder sibling to actor Robin Padilla and younger sibling to Royette and Rommel Padilla, both actors.
In January 2009, after returning from the United States, Padilla came out as a transsexual and changed her name to BB Gandanghari (sometimes spelled Bebe Gandanghari), claiming that the Rustom Padilla which the people used to know is already dead.
In an interview, Gandanghari stated the name is derived from the word Bb. (abbreviation of Binibining) Gandanghari, translated in English to Miss Beautiful King, and it's also a reference of her personal motto of "Be all that you can be".[2][3]

Background

As Rustom Padilla, he entered show business as a matinee idol and later as an action star. He also once hosted a franchised version of Wheel of Fortune on ABC 5. After her hosting stint, Rustom left the Philippines and studied filmmaking in the US.
Padilla appeared in the film version of the comic book Zsazsa Zaturnnah (her first gay role in a film since coming out) as the gay salon owner Ada (Adrian), alter ego of Zsazsa Zaturnnah, in TV series La Vendetta via GMA 7 and movie Happy Hearts. He was also a cast of ABS-CBN's Eva Fonda.
In 2009, Gandanghari hosted the National Kidlat Awards in Boracay, Philippines. She appeared again in SRO Cinema Serye: Rowena Joy.

She became one of the 14 housemates in Pinoy Big Brother: Celebrity Edition. On March 2, 2006, she came out of the closet on the show by telling fellow housemate Keanna Reeves that she is gay[5] On day 45 of the competition, Rustom opted to voluntarily leave the house.
In January 2009, Padilla came out as a transsexual. Pia Guanio herself announced that she has given birth to her first-born by husband Steve Mago on Friday, Aug. 31.

Their “little angel,” the Kapuso host tweeted, is named Scarlet Jenine.

“At 1255am today, Scarlet Jenine was born. Heavy at 7.8 pounds and tall at 20 inches! Thank you Lord for the wonderful gift in our lives!” Pia posted in her official Twitter account.

Before the delivery, Pia even tweeted that she’s on her way to the hospital.

“Scarlet and I will be going to the hospital soon. Help us pray it will be quick, normal and free of complications!” she said.

The brand-new mom added, “And thanks to everyone else who tweeted their good intentions, wishes and prayers! God bless you too!”

Iza Calzado, John Lapus, and Isabelle Daza, among others, sent their greetings for Pia via the social networking site.

Rise of Asian Chat Apps Threaten Facebook on Mobile said...

A new report from the folks over at Distimo looks at which mobile social networks are doing well around the world, and specifically which networks are winning out in Apple’s App Store for the biggest global markets.
While Facebook (NASDAQ:FB - News) is still the world’s dominant social network app on mobile, some changes over the past year in Asia now mean that it “its dominance is not as apparent” as the year before, says Distimo.
We have watched the rise of Line, NHN Japan’s popular chat application, and Distimo says that it was the most popular mobile social network app for iOS in Japan, Taiwan and Singapore. NHN Japan now claims about 55 million users in total (across multiple platforms) and has its eyes on China, although that market is sure to prove difficult.
Speaking of the Middle Kingdom, in China the top social app was WeChat, which is also coming on very strong (it was tops in Hong Kong too). Korea also has a strong mobile social challenger in KakaoTalk, which was the most popular in Korea.
Distimo also looked at which countries has the biggest appetites for social applications. Surprisingly the Asian nations were less social than the average. In the United States, the download volume for the social category in the App Store accounts for 20 percent of the ‘Top Overall’ download volume (see chart below). In contrast, Asian countries affinity for the social apps category is far less. In Singapore the figure was 14 percent, and it was far less in Japan and Korea (10 percent each), and lesser still in China, Taiwan, and Hong Kong (nine, eight, and seven percent respectively).

Robert Pattinson ‘moving to UK’ said...

Robert Pattinson is reportedly planning a return to London to rid himself of "bad memories" in Los Angeles.
The British actor has apparently put the Los Angeles home he once shared with Kristen Stewart up for sale, following her affair with director Rupert Sanders. The actor is now considering moving back to the UK as part of his plan to make a fresh start.
“Robert is thinking long and hard about returning to London,” a source close to the star revealed to Radar Online.
“He’s selling his home in Los Angeles, not only because it holds bad memories, but because he wants a fresh start."
Despite making friends and a successful career for himself in America, Robert has never felt settled in the US. The actor is reportedly even more homesick now he has split with his Twilight co-star Kristen. Robert is apparently leaning towards the idea of returning to his family once the sale of his $6.3 million Los Feliz home is complete.
“He never fell in love with Los Angeles and has always longed for home. When Kristen was shooting Snow White and the Huntsman in London, he made his excuses to visit her as much as he could - he missed it so much," the source continued.
“He is set to make up his mind very soon – his family hasn’t put pressure on him to return – but he misses them very much and they’ve said they’d welcome him back with open arms."
Robert has already taken steps to start making his fresh start following Kristen's betrayal.

Roxas admits: I have big shoes to fill said...

Former Senator Mar Roxas admits he has big shoes to fill in replacing the late Interior Secretary Jesse Robredo.

The well-loved Robredo passed away in a plane crash late August.

"I have big shoes, tsinelas, to fill," said Roxas, referring to Robredo's legacy of 'tsinelas' (slippers) leadership, or being an exceptional down-to-earth official.

Roxas said he's no Robredo but he will ensure that Robredo's plans will continue.

"Hindi po ako si Jesse Robredo. Kumpara sa kaniya, marami akong kakulangan. Pero gagawin ko ang lahat upang bigyang respeto ang legasiya ni Sec Jesse," he added.

Roxas said that under his watch, DILG will ensure "transparency, accountability, and people empowerment."

Roxas also noted that Robredo's widow, lawyer Leni Robredo, has his support.

"Salamat kay Atty. Leni sa supporta at kumpyansa. Hindi mababalewala ang mga intinanim ni Sec Jesse sa kaniyang trabaho," said Roxas.

Critics: Roxas appointment is traditional politics said...

Militants were quick to condemn the appointment of Manuel Roxas II, president of the administration Liberal Party, as head of the Department of Interior and Local Government, saying it exposed the department to partisan politics.

Bayan Muna Representative Teddy Casino, who is eyeing a seat at the Senate in 2013, said the appointment will "definitely further politicize the position and make the DILG even more vulnerable to patronage politics and unfair machinations by the ruling party."

Casino said on his Twitter account, even before the appointment was made official, that he viewed the choice of Roxas, seen as the LP's likely presidential candidate in 2016, with apprehension.

Casino is reportedly considering running under the United Nationalist Alliance, a coalition between former President Joseph Ejercito Estrada’s Pwersa ng Masang Pilipino and PDP-Laban, chaired by Vice President Jejomar Binay.

Youth group Anakbayan also criticized the appointment, saying it "shows how hypocritical and unabashedly trapo (traditional politician) the Aquino administration is."

In a statement, Anakbayan chair Vencer Crisostomo said Roxas' appointment was the exact opposite of the "brand of leadership DILG secretary Jesse Robredo was praised for." Crisostomo also cited the Liberal Party's seeming inability to get Robredo confirmed by the Commission on Appointments. Robredo, for a time, "shared the DILG with 'kabarilan' (DILG Undersecretary) Ronaldo Puno," he said.

"Roxas' appointment smacks of patronage politics and will further strengthen the trapo ways of government, considering that elections are fast approaching," he said.

But there were also words of praise for the incoming Local Government secretary.

PH has 1,684 new physicians said...

The Professional Regulation Commission says 1, 684 of 2,137 who took the Physician Licensure Exam in August passed.

The examinations, which were given by the Board of Medicine, were conducted in Manila, Cebu, and Davao.

The University of the Philippines-Manila got a passing rate of 99.35 percent in the August Physician Licensure Exam with 153 of 154 examinees passing the exam.

Exam topnotcher Carol Stephanie Tan, who scored 89.75 percent, comes from UP.

Aaron Joseph Kho Tiu (88.50), Michael Lawrenz Co (88), and Mariel Dianne Velasco (87.92) who placed fourth, fifth, and six resepctively, are also from UP.

UP graduates Julie Anne Gabat and Orlyn Claire Lavilla shared tenth place with a score of 87.42 percent.

UP was followed closely by the University of Santo Tomas with a passing rate of 98.71 percent and Ateneo de Manila University with 98.39 percent.

UST graduates Alexander Manguba Jr. (89.08) and Nellowe Candelario (89.00) placed second and third among the Top 10 examinees. Two more Thomasians, Patricia Amolenda and Mar Angelo Carrasco, made it to the top 10, sharing eighth place with 87.67 percent.

De La Salle University-Health Sciences Instute, which got a passing rate of 86.72 percent, had three graduates on the top 10. Marjorie Anne Bagnas scored
88.50 percent, putting her at fourth place while her schoolmate Elmer Gabutan scored 87.83 to place seventh. Rachelle Mendoza placed ninth with a score of 87.50.

Randy Dabu from Far Eastern University-Nicanor Reyes Medical Foundation scored 87.83 percent, putting him in seventh place. FEU-NRMF had a passing rate of 89.29 percent out of 112 examinees.

"Registration for the issuance of Professional Identification Card (ID) and Certificate of Registration will start on Tuesday, September 4, 2012 but not later than September 7, 2012," PRC said.

It's official: Mar Roxas is new DILG chief said...

(UPDATE) President Benigno "Noynoy" Aquino III has officially appointed his ally, Telecommunications Secretary Manuel "Mar" Roxas to the plum Interior and Local Government post.

At the same time, Aquino appointed Cavite Rep. Joseph Emilio Abaya to replace Roxas as Telecommunications chief.

"Sa pagtatalaga natin kina Mar at Jun, kumpiyansa tayong higit pang mapapabilis ang pag-usad natin sa tuwid na daan," Aquino said in a press conference Friday.

Aquino said he appointed the two to ensure that the administration's agenda for change will push through. He also asked the Commission on Appointments to immediately confirm Roxas and Abaya.

"Mar was at the top of the very short list," added Aquino when asked if he had a hard time deciding who to appoint, amid many suggested names including Senator Panfilo Lacson, Davao Vice Mayor Rodrigo Duterte, and Vice President Jejomar Binay.

When asked about the late Interior Secretary Jesse Robredo's similarities with Roxas, Aquino said: "Robredo and Mar, they both share my trust, my complete trust."

"Kapag maling tao ang inilagay mo diyan, magsasamantala sa pwesto. Pangalawa, Kasipagan," he added.

"Mar is very capable to handle this job. He will put in his own personal style," said Aquino, adding that Roxas can pick his workmates at the department and bring in some if necessary.
As DILG Chief, Roxas has power over local government units nationwide, the Philippine National Police, and the Bureau of Fire Protection.
In his announcement statement, Aquino said: "Isang taong may kakayahang kumilos at tumugon sa tawag ng paglilingkod, at magsilbing tulay upang tiyakin na mula sa kapulisan hanggang sa lokal na pamamahala, tumatahak nang nagkakaisa tungo sa iisang direksyon ang ating bansa. Sino pa nga ba ang sasalamin sa lahat ng katangiang ito kundi ang Pangulo ng aming partido na si Kalihim Mar Roxas."
Roxas was Aquino's running mate in the 2010 Presidential elections. Roxas is also the Liberal Party president.

Men who love chocolate have lower stroke risk: study said...

REUTERS - Fancy a chocolate bar? Regularly indulging in the snack may actually help men decrease their risk of having a stroke, according to a Swedish study.
Researchers writing in the journal Neurology found that of more than 37,000 men followed for a decade, those who ate the most chocolate - typically the equivalent of one-third of a cup of chocolate chips - had a 17 percent lower risk of stroke than men who avoided chocolate.
The study is hardly the first to link chocolate to cardiovascular benefits, with several previous ones suggesting that chocolate fans have lower rates of certain risks for heart disease and stroke, like high blood pressure.
"The beneficial effect of chocolate consumption on stroke may be related to the flavonoids in chocolate," wrote Susanna Larsson, at the Karolinska Institute in Stockholm, who led the study.
Another study she conducted last year found similar results for women.
Flavonoids are compounds that act as antioxidants and may have positive effects on blood pressure, cholesterol and blood vessel function, according to studies.
For the study, 37,000 Swedish men aged 49 to 75 reported on their usual intake of chocolate and other foods. Over the next 10 years, 1,995 men suffered a first-time stroke.
Among men in the top 25 percent for chocolate intake, the stroke rate was 73 per 100,000 men per year. That compared with a rate of 85 per 100,000 among men who ate the least chocolate, report the researchers.
Larsson's team had information on other factors, such as the men's weight and other diet habits, whether they smoked and whether they had high blood pressure. Even with those factors considered, men who ate the most chocolate had a 17 percent lower stroke risk.
Other researchers, though, noted that none of the studies to date have proved that chocolate is the reason for the lower stroke risk.
"It's very important for people to take the news on chocolate with a grain of salt," said Richard Libman, vice chair of neurology at the Cushing Neuroscience Institute in Manhasset, New York.
Libman said the theory that flavonoids may have a positive impact remains just a theory and that a wide range of much healthier foods also contain flavonoids - such as apples, kale, broccoli, soy, tea and nuts.

Apparently, even U.S. business executives think it's more fun in the Philippines.

Expatriates currently working in the Philippines seem to be enjoying their stay here, results of the US Chamber of Commerce's latest Association of Southeast Asian Nations (ASEAN) Business Outlook Survey showed.

Surveyed American firms operating in the Philippines answered yes when asked: "Are your expatriate employees generally satisfied with their assignments in your response location?"

The 100-percent score is an increase from 93 percent in 2011 and 86 percent in 2010.

Other Southeast Asian countries also had generally high scores, with the regional average pegged at 96 percent. Aside from the Philippines, Malaysia also got a score of 100 percent in the said indicator.

A growing number of employees in American companies also want to be transferred to the Philippines.

Results of the survey showed that two out of five (40 percent) locally operating American firms said they regularly receive requests from employees based on other locations to work in the Philippines.

This is an increase from 21 percent in 2011 and 15 percent in 2010.

The Philippines got the third highest response in "expatriate assignment satisfaction" within the region, even as it remained below the regional average of 51 percent. It was topped only by Singapore, 75 percent and Malaysia, 40 percent.

More and more employees also want to stay in the Philippines longer, the survey showed further.

Australia lets Chinese buy huge cotton farm said...

The Australian government said Friday it will allow the sale of the nation's giant Cubbie cotton station to a consortium led by Chinese textile company Shandong RuYi.
Rural conservative politicians have warned against selling valuable farming land to foreign investors, particularly China, which is Australia's top trading partner.
But Treasurer Wayne Swan said textile firm Shandong RuYi Scientific and Technological Group Co. and Australian firm Lempriere were approved to acquire the Cubbie Group subject to a number of undertakings.
"Critically, RuYi has undertaken to sell down its interest to no more than 51 percent within three years," Swan said, adding that it will initially own 80 percent of the group and Lempriere 20 percent.
Cubbie Group, which stretches over 96,000 hectares in southern Queensland, was placed into voluntary administration three years ago after financial difficulties brought on by years of harsh drought.
Swan said a number of attempts had been made to find a buyer for the company and bring an end to a long period of uncertainty.
The assessment by the Foreign Investment Review Board, necessary for any property sale price exceeding a threshold of Aus$244 million (US$251.5 million), had now given the green light to the proposal from RuYi -- which is owned by a consortium of investors in China and Japan -- and Lempriere.
The Australian newspaper said Friday that the price would likely be under the Aus$300 million previously flagged, in part due to falling cotton prices.
"The government welcomes foreign investment in Australia and continues to ensure that investments are consistent with Australia's national interest," Swan said in a statement.

Pinoy fighters Kelly, Folayang conquer foes at ONE FC MMA said...

Eric Kelly and Eduard Folayang, both proud Igorot warriors, carried the Philippine flag proudly last night in the ONE FC: Pride of a Nation Mixed Martial Arts fight card at the Smart Araneta Coliseum.

Kelly downed former Ultimate Fighting Championship Lightweight champ Jens Pulver with a TKO in the second round while Folayang impressed the judges for a stylish unanimous decision over Peruvian-Swiss-Japanese Felipe Enomoto.


"He's the Manny Pacquiao of MMA" said Pulver, a 37-year old American legend of the MMA wars.

Kelly entered the ring with an Igorot headband with a Philippine flag on it. Pulver took the first round but in the second 5-minute period Kelly caught the American with a wicked combination of punches. Moments later, the referee called a halt to the proceedings and gave Kelly the fight to the joy of the huge crowd at the Coliseum.

All sections from ringside to Upper Box A were sold out, with many Upper Box B seats also filled.

The 28-year-old featherweight now improves his perfect record to 8-0 and is slated to contend for the 145-pound ONE FC belt in October in Singapore versus fellow Pinoy Honorio Banario.

Folayang had a tougher matchup against Enomoto. The first round of their bout was cagey and close, but in the second Folayang, nicknamed "The Landslide" took command.

He was the aggressor all throughout the second round, connecting on several punches and bloodying the Peruvian. In the closing seconds, Folayang took him down and rained a flurry of shots at Enomoto.

The third round was tight with Enomoto desperately trying to make headway. But the judges felt Folayang was clearly the better fighter and called it a unanimous decision. Folayang's win-loss slate is now 12-2.

Fil-Canadian ONE FC president Victor Cui announced after the match that Folayang would also fight for a belt in October, this time the 155-lb title.

Honorio Banario had earlier outclassed another Filipino, Andrew Benibe, knocking him out in the third round.

Azkals cleared of sexual harassment charges, but draw suspensions said...

The Philippine Football Federation (PFF) Disciplinary Committee has cleared players Angel Guirado and Lexton Moy of the sexual harassment charges filed by FIFA official Cristy Ramos, according to reports, but slapped the two with one-match suspensions for a "breakdown in discipline".

“Cristy Ramos verdict out: PFF Disciplinary committee finds the players innocent of the sexual harassment charges, pls RT” tweeted longtime football supporter Craig Burrows Friday afternoon.

PHI_Azkals, which is the official twitter account of the Philippine national football team, tweeted a similar message: “PFF Disciplinary Committee clears Azkals of the sexual harassment charge filed by Cristy Ramos.”

It will be recalled that Ramos filed the sexual harassment charges shortly after the Azkals’ friendly against Malaysia last February 29, where she served as match commissioner. Ramos alleged that during the pre-match team check in the Azkals’ locker room, Moy made a remark on a bra size which she felt alluded to, while Guirado stood in front of her wearing only his underwear.

To quote part of the letter that Ramos sent to Asian Football Confederation (AFC) Disciplinary Committee Chairman Lim Kia Tong:

“As I called the players individually so that we could check their accreditation cards and kits, Philippine player Lexton Moy (no. 25) stood by my right side and said in a loud voice 'Must be a B cup,' to which the players laughed loudly. As I was the only female in the room, he was apparently referring to my bra size. He could not have been talking about men's athletic cups, as their sizes are specified as extra-small, small, medium, large, and extra-large vis-a-vis cup sizes of women's brassieres, which are specified in letters.

“Additionally when I checked Philippine player Angel Guirado (no. 12) he stood in front of me purposely just wearing his briefs and made no attempts to wear shorts or cover his underwear. Again, the players loudly laughed while I was checking this player.”

The committee, though, issued sanctions against Guirado, Moy and four others, including coach Hans Michael Weiss and team manager Dan Stephen Palami for a "breakdown in discipline" and "failure of leadership". The two players, along with team captain James Younghusband and assistant coach Edzel Bracamonte, were slapped one-match suspensions while Weiss and Palami, who were not in the locker room at the time of the inspection, were meted two-match suspensions.

In a statement, Palami said they were not surprised that Guirado and Moy were exonerated, but added they would be appealing the suspensions.

"The Disciplinary Committee has found no evidence of sexual harassment and we thank them for that," Palami said in the statement. "It is to the relief of the team and the management that such a serious charge has been found to be without foundation but this is no surprise to us.

"However, other parties not involved with the case were handed suspensions. With full respect to the Disciplinary Committee we will be appealing the decision."

Twin suicide attack on NATO Afghan base kills 12 said...

Ten civilians and two police were killed and dozens more were wounded Saturday in a Taliban twin suicide attack targeting a US-run military base in central Afghanistan, officials said.

The first bombing was carried out by a militant on foot, followed by a huge blast from a truck bomb that destroyed much of a local bazaar near the military outpost in Wardak province's Sayedabad district, police said.

"The number of wounded is so high that it can hardly be counted. Lots of people have been wounded and much of the Sayedabad bazaar has been destroyed," Wardak police spokesman Abdul Wali told AFP.

Ghulam Farouq Mukhlis, the provincial public health director, told AFP that at least 43 civilians were admitted to local hospitals. Ten people were evacuated to the capital Kabul for "serious injuries", Mukhlis added.

A Western military official close to the NATO's International Security Assistance Force (ISAF) who spoke anonymously told AFP that two ISAF soldiers were wounded in the blasts.

"There were no ISAF fatalities," an ISAF spokesman told AFP separately, confirming the twin blast.

Shahidullah Shahid a spokesman for the provincial administration confirmed the attack, describing the truck-bombing as "massive".

"A suicide bomber on foot detonated near the gate of the base in Sayedabad, Wardak province, opening the way for a truck suicide bombing that followed him," Shahid told AFP.

Sayedabad is an insurgency-plagued region and the base there was attacked in a truck bombing in September last year. More than 80 people, about 50 of them US soldiers, were wounded in that attack.

A witness said a small bazaar near the base, which is located along a highway that links capital Kabul to the southern province of Kandahar, was "totally destroyed" by Saturday's explosion.

Afghan and Western troops blocked the road after the blasts for more than an hour, causing traffic jams along the busy highway, the witness, who refused to give his name, told AFP. "They were huge explosions, very big," he said.

Many civilians work on or near NATO bases and bazaars.

Zabihullah Mujahed, a spokesman for the Taliban insurgents, claimed responsibility for the attack in a text message to AFP.

The United Nations says 1,145 civilians were killed and 1,954 wounded in the war in the first six months of this year, with the world body blaming 80 percent of the deaths on insurgents.

NATO has some 130,000 troops in Afghanistan fighting the Taliban's decade-long insurgency alongside government forces.

Death toll in China mine blast rises to 43 said...

The death toll from a gas explosion at a Chinese coal mine has risen to 43, state media reported Saturday, with three miners still remaining underground.

Yang Dongliang, head of the State Administration of Work Safety (SAWS), said the number of deaths had increased and that rescuers were looking for the three trapped miners, the official Xinhua news agency reported.

The explosion occurred late Wednesday at Xiaojiawan mine in southwest China's Sichuan province and marked the latest in a string of fatal incidents for an industry known for poor safety.

The death toll matches that from a blast at a mine in November last year in southwestern Yunnan province.

China's mines are among the world's deadliest due to lax regulation, corruption and inefficiency. Accidents are common because safety is often neglected by bosses seeking quick profits.

The latest official figures show 1,973 people died in coal mining accidents in China in 2011, a 19 percent fall on the previous year, though labour rights groups say the actual death toll is likely to be much higher.

Authorities ordered that the Xiaojiawan mine be shut and fined the company operating it five million yuan ($800,000), while 19 people were sent to face legal action, SAWS investigators said in a report earlier.

They blamed the accident, estimated to have cost 40 million yuan ($6 million) in economic losses, on illegal operation and inadequate safety policies.

Separately, China National Radio reported that Zhang Yan, the mayor of Panzhihua city in Sichuan where the mine is located, bowed and apologized Saturday to family members of the dead at the mine.

Clinton says Pacific big enough for US, China said...

US Secretary of State Hillary Clinton said that the South Pacific was big enough for both the United States and China but urged the Asian power to distribute its growing aid fairly.

Clinton vowed that the United States would remain committed to the South Pacific "for the long haul" and offered new aid as she became the first US secretary of state to take part in an annual summit in the vast but sparsely populated region.

Her visit comes as several island states forge closer ties with China, which according to Australia's Lowy Institute has pledged more than $600 million in low-interest and mostly strings-free loans to the South Pacific since 2005.

Clinton, who will visit Beijing next week for talks on the often fractious relationship between the world's two largest economies, played down rivalries in the South Pacific during the summit in the tiny Cook Islands.

"We think it is important for the Pacific island nations to have good relationships with as many partners as possible and that includes China and the United States," Clinton told reporters.

Amid criticism that China's open wallet has undermined international pressure for democracy in Fiji and other nations, Clinton said: "Here in the Pacific, we want to see China act in a fair and transparent way".

Clinton, in an address to the 15-nation Pacific Islands Forum, said that all nations had "important contributions and stakes" in the security and prosperity of the region.

"I think, after all, the Pacific is big enough for all of us," she said, in a line she used repeatedly during her visit.

Chinese state media have accused Clinton of seeking to "contain" the rise of the Asian nation through her latest tour of the region.

But Vice Foreign Minister Cui Tiankai sounded a conciliatory note during the Pacific Islands Forum, saying Thursday that China was "in this region not to seek any particular influence, still less dominance.

"We're here to be a good partner for the island countries, we're not here to compete with anyone," he told reporters.

Cui said that China was willing to work with other countries but added: "It will not mean that China will have to change its foreign aid policy. We are not changing it."

Any potential US attempt to contest China's role would be fraught with difficulties as several nations in the region have embraced China, with Samoa's leader saying in June that the Asian power was a greater friend than Washington.

Prime Minister Henry Puna of the Cook Islands welcomed the renewed US interest but made clear the region would not distance itself from China.

"We have a very close relationship with the People's Republic of China and I make no bones about it," he told reporters.

Coco, Matteo end rift said...

Coco Martin and Matteo Guidicelli finally reconciled a year after their fist fight at the Star Magic Ball.

Matteo himself handed out the “Standout Award” to Coco at the 6th Star Magic Ball on Saturday, Sept.1, at Makati Shangri-la Hotel. Matteo even introduced Coco as “kaibigan ko,” which drew cheers and applause from their fellow celebrities.

It was the first time their paths crossed after last year’s headline-hogging encounter.

Hug and kiss

Matteo asked for a hug and even jokingly kissed Coco’s hand. They were all smiles as they hugged each other.

“It’s fun, fun. I got the opportunity to hug him, kiss his hand,” Matteo told Yahoo! Philippines OMG! and other members of the press after the event.

It will be recalled that Coco and Matteo had a fist fight in last year’s ball over the latter’s former girlfriend, Maja Salvador. Matteo, who has always wanted to make peace with Coco, feels good about their reconciliation.

“Since dati pa naman, I’m the one always talking and approaching. It’s good. It’s very nice na lahat sa Star Magic, peace lahat, magkakaibigan. Parang pamilya kami dito, parang magulang namin sila Mr. M (Johnny Manahan) and Ms. Mariole (Alberto),” Matteo said.

How does Maja feel about the reconciliation?

“Maja has no issue with that. She doesn’t really care about that,” Matteo answered.

Matteo seems to have no time for a new love. He has a new TV drama “Isla” an indie movie. He is also active in triathlon races.

Matteo and Maja have remained friends.

'Promising future' forecast for Philippines said...

Manila (Philippine Daily Inquirer/ANN) - The Aquino administration said the Philippines was up for a "promising future" that investors should take advantage of, saying there was a good chance the economy would grow more than 7 per cent a year for at least 10 years after 2015.

On top of the country's favourable economic fundamentals, the administration said the so-called "demographic window" that the Philippines would enjoy by 2015 could make the country a good investment destination.

"A promising future lies ahead," the government said in its latest economic presentation distributed online to foreign sub scribers, which included businessmen, bankers and economists.

The "demographic window" is the period when the bulk of an economy's population is of working age. In particular, it is the time when the proportion of the population aged 15 years old and younger falls below 30 per cent and when the proportion of the population aged at least 65 years old drops to less than 15 per cent.

Such a period should be enticing to businesses because it is when labour supply and income-earning consumers are abundant and an economy becomes more productive.

The Aquino administration said the demographic window would add icing to the cake for investors, citing the favourable macroeconomic indicators, including low inflation, sustained economic growth, a healthy banking sector, and strong remittances from overseas Filipinos that help fuel household consumption.

Citing a study by the United Nations, the government said the Philippines would follow the lead of strong Asian economies that previously entered the demographic window.

"The Philippines is the last major Asian economy to benefit from this demographic dividend, which is typically associated with accelerated economic growth," the government said.

The country is expected to enjoy a robust growth rate of more than 7 per cent over the long term starting 2015, saying some Asian countries, led by Japan, Hong Kong, Singapore, South Korea and China, experienced fast growth rates in the long term following their entry to the demographic window.

Japan entered the demographic window in 1965, Hong Kong and Singapore in 1980, South Korea in 1985, China in 1990 and Thailand in 1995.

Other neighbouring countries have entered this window fairly recently. Indonesia and Vietnam did so in 2005, and Malaysia and India in 2010.

The average economic growth rate of selected countries for 10 years following their entry to the demographic window was 7.3 per cent, the government said.

The Aquino administration aims to woo more long-term foreign investors into the country in the belief that investments from abroad were necessary to help create more jobs and reduce poverty.

The Philippines continues to lag behind other emerging Asian economies in terms of cornering foreign direct investments (FDIs).

Documents from the Bangko Sentral ng Pilipinas showed that the net inflow of FDIs amounted to US$844 million in the first five months of the year. This was up by about 10 per cent from $766 million in the same period last year, but was one of the smallest among emerging Asian economies.

Inmates ready to 'iron' Marzans said...

MANILA, Philippines - Inmates at the Quezon City Jail warned yesterday a couple accused of abusing their former helper that they will get the same treatment they allegedly gave her.

“We are ready here. Our irons are ready for them,” the inmates at the jail’s female dormitory chanted in Filipino upon hearing the news that Annaliza Marzan was on her way there.

Marzan and her husband, Reynold, are facing charges for reportedly beating Bonita Baran during the five years she worked for them. Baran had alleged that Annaliza used an iron on her face.

The couple had asked Judge Germano Francisco Legaspi of the Quezon City Regional Trial Court Branch 77, to allow them to be detained at the National Bureau of Investigation (NBI), where they had surrendered. Legaspi earlier issued a warrant for the Marzans’ arrest on charges of serious illegal detention, a non-bailable offense.

Apart from the charges of serious illegal detention, Annaliza was also charged with two counts of attempted homicide before the RTC and seven counts of serious physical injury before the Metropolitan Trial Court.

The prosecutor who conducted the preliminary investigation of the complaints filed by Baran dismissed the charges against Reynold as an accessory to the crime of serious physical injuries and attempted murder for insufficiency of evidence.

As the judge decided on the request, Annaliza and Reynold were brought to the jail’s female dormitory, which is housed at Camp Karingal by Senate personnel at past 3 p.m. Minutes later, Senate personnel escorted Reynold out of the female dormitory and brought him to the main jail facility along EDSA.

Legaspi issued his ruling denying the Marzans’ motion at past 4 p.m.

In junking the motion, Legaspi said he found no compelling reason to depart from the mandate of Republic Act 6975, which states that persons awaiting trial shall be detained at the city jail.

“Any perceived inconvenience the children might suffer in visiting their parents at different detention cells is so insignificant so as to warrant the detention of both accused at the NBI,” the judge said.

Legaspi said the couple did not present during the court hearing evidence that would support their claim that Annaliza has a kidney ailment, such as a medical certificate and the testimony of a qualified doctor.

The couple’s lawyer, Joel Ferrer, said in the motion that it would be more convenient for the couple’s three children to visit them at the NBI detention center.

Dog stands guard over deceased owner’s grave for six years said...

An extremely dedicated dog has continued to show its loyalty, keeping watch on its owner's grave six years after he passed away.

Capitan, a German shepherd, reportedly ran away from home after its owner, Miguel Guzman, died in 2006. A week later, the Guzman family found the dog sitting by his grave in central Argentina.

Miguel Guzman adopted Capitan in 2005 as a gift for his teenage son, Damian. And for the past six years, Capitan has continued to stand guard at Miguel's grave. The family says the dog rarely leaves the site.

"We searched for him, but he had vanished," widow Veronica Guzman told LaVoz.com. "We thought he must have got run over and died.

'The following Sunday we went to the cemetery, and Damian recognized his pet. Capitan came up to us, barking and wailing as if he were crying."

Adding to the unusual circumstances, Veronica says the family never brought Capitan to the cemetery before he was discovered there.

"It is a mystery how he managed to find the place," she said.


Cemetery director Hector Baccega says he and his staff have begun feeding and taking care of Capitan.

"He turned up here one day, all on his own, and started wandering all around the cemetery until he eventually found the tomb of his master," Baccega said.

"During the day he sometimes has a walk around the cemetery, but always rushes back to the grave. And every day, at six o'clock sharp, he lies down on top of the grave, stays there all night."

But the Guzman family hasn't abandoned Capitan. Damian says the family has tried to bring Capitan home several times but that he always returns to the cemetery on his own.

"I think he's going to be there until he dies, too. He's looking after my dad," he said.

A convenient scapegoat said...

Philippine media have their ample share of problems, one of them irresponsible reporting, but on the report on alleged support of Singapore for the Philippine position in the West Philippine Sea, they correctly reported what was officially conveyed to them.

The statement released by the Singapore Ministry of Foreign Affairs last Sept. 10 insulted Philippine media.

The statement:

"MFA has received media queries referring to articles in the Philippine Star and Manila Bulletin published on 9 September 2012, reporting that Singapore supported the Philippines' position in the South China Sea dispute during Prime Minister Lee Hsien Loong's meeting with Philippine President Benigno Aquino on the sidelines of the 20thAPEC Economic Leaders' Meeting in Vladivostok on 8 September 2012. I was only able to retrieve online the Manila Bulletin article by Madel R. Sabater referred to in the statement. The head was "Singapore Backs PH Stand In South China Sea Dispute."

Dated Sept. 8, the dateline was Vladivostok, where the leaders of the Asia Pacific Economic Cooperation were meeting. The story was based on the briefing of Foreign Secretary Albert del Rosario on the meeting of President Aquino and Singapore Prime Minister Lee.

The lead was "Singaporean Prime Minister Lee Hsien Loong on Saturday expressed support to the Philippines' efforts for a peaceful resolution of the dispute in the West Philippine Sea (SouthChina Sea).

The quote supporting the head, was the fifth paragraph which said: "He (del Rosario) said Aquino thanked Lee 'for the very strong support that Singapore has given the Philippines in terms of its position in the West Philippine Sea.'"

GMA News had the same story . It said, "On Saturday, del Rosario said Aquino thanked Lee for Singapore's support for the Philippines' position on the West Philippine Sea. " It used the same quote in the Manila Bulletin story.

The President also said more or less the same thing in his arrival statement: "Nagpaabot naman ng mainit na suporta ang mga pinuno ng mga bansang Singapore, Malaysia, at Vietnam ukol sa mga paksang may malawak na epekto't implikasyon sa ating rehiyon, partikular na sa usapin sa West Philippine Sea."

We understand that it would have serious diplomatic repercussions if the Singapore MFA insulted Del Rosario but must they insult Philippine media?

Without admitting the Del Rosario's mistake, the Department of Foreign Affairs issued the following statement: "''It is correct to say that Singapore is not taking sides in the territorial disputes in the WPS. Singapore supports the same principled position of the Phil. in pursuing a resolution of disputes through peaceful means in accordance with international law. It moreover encourages the exercise of restraint and is against the use of force. Finally, it also shares with us the desire to have an early conclusion of the ASEAN - China Code of Conduct of Parties in the SCS.''

1 dead, 7 hurt in mall heist, bank blast said...

MANILA, Philippines - A suspected robber died and seven others were wounded in a mall robbery and bank explosion that happened simultaneously at the Madrigal business district in Muntinlupa City yesterday morning.

The fatality, identified as Pepito Paler, was one of the five men seen robbing a bank teller in Alabang Town Center (ATC) at about 10:05 a.m., or an hour before the mall opens.

The bank teller had just alighted from an armored van and was about to deliver a backpack full of money to Czarina Foreign Exchange when Paler threw a hand grenade. It did not explode, giving time for the security guards to engage the robbers in a shootout.

“The teller and (the) companion got frightened, ran away, and left the bag behind. The security guards, meanwhile, fired shots at Paler and his accomplices,” said Senior Superintendent Rolando Asuncion. The amount of money taken by Paler’s alleged accomplices – three robbers fled on two motorcycles driven by two other men – has yet to be determined.

Security guards Lope Bacomo and Alexander Sablado, brought to the hospital for gunshot wounds, are in stable condition.

A bullet-riddled orange Mitsubishi sedan was found abandoned near the mall. Police are checking who owns the car.

This is the second time this year that armed robbers attacked personnel of armored vans just as they were about to deliver money to a branch of Czarina Foreign Exchange at the ATC.

Last February, members of Ozamis robbery group also tried to rob the foreign exchange’s branch in ATC’s Alabang-Zapote entrance but was foiled by a security guard, police said. The guard and a suspected robber died in the encounter.

Yesterday’s gunfight lasted about 15 minutes, said 77-year-old Japanese national Tsuyoshi Kishikawa, who was heading toward the Czarina Foreign Exchange shop when the firefight started. He said he had just parked his car near the Madrigal Avenue mall entrance when he heard gunshots.

“I was about to alight from the car when I heard the ‘bang, bang, bang’ from everywhere. So, I ducked and hid,” Kishikawa told The STAR as he re-enacted what happened.

Chief Inspector Giovanni Martinez, intelligence unit head of the Muntinlupa police, said they have yet to pinpoint the groups possibly involved in the heist.

Grenade explosion

At about the same time, a branch of Sterling Bank of Asia, located 150 meters from the mall, was hit by what police believe was a rifle grenade. The explosion shattered the bank’s glass walls and doors.

Like the mall, the bank is surrounded by several business establishments. Five people, including three bank personnel and two security guards, were reportedly wounded and rushed to the Asian Hospital and Medical Center.

Chief Superintendent Benito Estipona, director of the Southern Police District, said investigators are still looking into the possible connection of the two incidents.

Only Manny Pacquiao’s signature is needed to seal a fourth showdown Mexican rival Juan Manuel Marquez.

This was confirmed by Yahoo! Sports boxing expert Ronnie Nathanielsz, who said Pacquiao adviser Michael Koncz told him they are just awaiting the arrival of the Filipino boxing icon in the United States within the next day or two to formally ink the fight contract.

A formal announcement from Top Rank promoter Bob Arum will be made on September 18. The fight is scheduled for December 8 (December 9 in Manila) in Las Vegas and will reportedly be at 147 pounds, or four pounds above the 144-pound catchweight of the third fight.

Pacquiao will reportedly train exclusively at the Wild Card Gym in Los Angeles, deviating from his usual practice of spending his first few weeks of training for a fight in Baguio City.

Pacquiao narrowly beat Marquez when they last fought in November 2011, eking out a controversial majority decision. The Mexican walked out of the ring after the result was announced, and vowed to retire after what he felt was another unfair decision. But he fought again last April, winning the interim WBO light welterweight title with a unanimous decision over Serhiy Fedchenko.

Their second meeting, in March 2008, produced another close result, a split decision in favor of Pacquiao, who knocked Marquez down in the third round.

The two great rivals’ first meeting in May 2004 ended in a draw, with Pacquiao sending Marquez to the canvas three times in the first round and the Mexican rallying in the later rounds.

US sues top Philippine NGO execs said...

Manila (Philippine Daily Inquirer/ANN) - The United States government has accused the founder and president of Visayan Forum Foundation Inc. (VFFI), a group that has won international accolades for its campaign against human trafficking, of failing to account for 210 million pesos (US$ 5 million) in US aid, the National Bureau of Investigation said.

Based on the complaint of the US Agency for International Development (USAID), the NBI has recommended the prosecution in the Department of Justice of VFFI president Ma. Cecilia Flores-Oebanda, according to NBI antifraud chief Rachel Marfil-Angeles.

The VFFI provides education, shelter and psychological help to victims of trafficking. It receives funds from international donors such as the USAID, the US Department of State, Bill Gates Foundation and Starbucks.

The NBI also recommended the filing of charges against VFFI directors, finance officers, bookkeepers and other employees.

Angeles said charges of falsification of documents were filed against the respondents on September 6, based on the complaint of Daniel Altman (special agent in charge of the [Europe and Asia] Office of the Inspector General-USAID), the testimony of two whistle-blowers and boxes of falsified documents seized in a raid on the VFFI office in Cubao, Quezon City.

The whistle-blowers said VFFI fabricated the receipts and contracts to justify the expenses charged against the 300 million pesos donated by the USAID.

Fake receipts

Angeles said 210 million pesos of the 300 million pesos from the USAID remained unaccounted for. ¿However, what is clear at the moment, based on evidence, is that receipts for 41 million pesos had been faked,¿ said the NBI antifraud chief.

Angeles said the NBI probe had established that the order to manufacture the fake receipts came from the VFFI president.

¿In a meeting, the bookkeepers, including the whistle-blower, were allegedly ordered by its president to fake receipts to fill in the gap of unsubstantiated expenses,¿ she said.

Laurence Arroyo, lawyer of the VFFI, denied the NBI findings and said that a former VFFI employee could be behind the falsification of documents.

¿The VFFI did not manufacture fake receipts, and if ever there indeed was questionable receipts it must have been the work of the bookkeeper who has responsibility over these papers,¿ Arroyo said.

¿Ridiculous¿

The lawyer also described as ¿ridiculous¿ the statement of the bookkeeper that it was Oebanda who instructed the finance personnel to manufacture fake receipts to meet USAID audit requirements.

Satisfaction ratings soar for top gov't officials, institutions said...

Filipinos' satisfaction with officials in the highest positions next to the President as well as top state institutions have soared to all-time and personal highs, a Social Weather Stations (SWS) survey showed.

Vice-President Jejomar Binay, Senate President Juan Ponce Enrile and House Speaker Feliciano Belmonte have posted their highest ratings since the start of their term, the SWS said in a report originally published in BusinessWorld Friday.

Net satisfaction ratings for the Chief Justice, a position held by Associate Justice Antonio Carpio during the survey period, also bounced back to a positive level from a dismal low in May.

The Cabinet, Senate and the House of Representatives meanwhile reached record highs while satisfaction with the Supreme Court was seen at its highest in almost two years.

The SWS net satisfaction rating is the difference of the percentage of respondents which said they are "satisfied" wit an official's performance and those who are "dissatisfied."

Binay's net satisfaction rating rose to "excellent" at +76 in August from a +70 in May, thus marking his highest record since he took office in 2010.

This compares with the record +82 seen during the term of then Vice-President Joseph Estrada in April 1994.

Net satisfaction for Binay also topped the "very good" rating for President Benigno Aquino at +67, reported last week by SWS from the same survey.

Enrile meanwhile marked a new record high by posting a net satisfaction rating of +65 or "very good," up from his "good" rating of +48 in May.

Belmonte, for his part, saw a double-digit rise to a "moderate" +20 from his "neutral" rating in May.

The highest rating ever received by a House Speaker was +46 for then House Speaker Jose de Venecia, Jr. in June 1997.

Carpio, who acted as chief justice prior to the appointment of Ma. Lourdes Sereno, saw ratings improve to a "neutral" +3 from the record low of -44 given to Chief Justice Renato Corona in May, when he was facing impeachment.

New record highs were meanwhile seen for the Senate, the House of Representatives and the Cabinet.

Net satisfaction for the Senate jumped to "very good" at +67 from +49 or "good" in May, topping its previous best of +58 in March.

The House meanwhile beat the record high of +27 in March 1999, by getting a score of "good" at +42 in August, up from +30 in May.

A new record was also seen by the Cabinet, which was rated "good" at +33, rising from a "moderate" +19 in May. This is higher than the +27 record in March 1999 and June 1997.

The controversy-ridden Supreme Court was also rated "good" at +35 in August, climbing from a "moderate" +13 in May.

This is the highest rating for the high tribunal since +36 in November 2010, although it failed to beat the record +39 in March 1999.

Manny Pacquiao's willingness to 55-45 financial split puts onus squarely on Floyd Mayweather Jr. said...

The burden, finally, is fully and entirely on Floyd Mayweather Jr. to make a fight with Manny Pacquiao.

Pacquiao agreed Thursday during appearances on two separate television shows on ESPN to give Mayweather a 55-45 advantage on a financial split should they fight, as the public has been demanding since late 2009. A match between them is expected to be the most lucrative bout in boxing history.

Pacquiao, who meets Juan Manuel Marquez for a fourth time on Dec. 8 in Las Vegas, had been demanding a 50-50 split. Without such a split, he’d said repeatedly over the last 18 months that he would not agree to a fight with Mayweather.

The other major hurdle blocking the fight between the two men regarded by many as the two best in the world was Mayweather's demand for Olympic-style drug testing. Initially, Pacquiao balked at the testing. He has since changed his stance and has said repeatedly over the last year he would fully comply with the tests, just as Shane Mosley, Victor Ortiz and Miguel Cotto have done in Mayweather's last three fights.

In a telephone interview with Yahoo! Sports on Monday, Pacquiao made no mention of a purse split, but he was as optimistic about the possibility of a fight with Mayweather as he had ever been.

"I think Mayweather will be next," Pacquiao said, declining to specify why.

But by agreeing to give Mayweather the lion's share of the purse, Pacquiao has shifted the onus to Mayweather.

If Mayweather raises new objections, then it becomes obvious he's not serious and is playing some sort of game.

But at this stage, with the demand for the bout seemingly waning a bit because of all the inaction and drama that has surrounded the talks, it would be a miscalculation for Mayweather to add more conditions.

Mayweather is very much aware of his place in history and wants the fight badly because he doesn't feel as if he's received enough credit for his achievements. He’s 43-0 with 26 knockouts. He won a bronze medal at the 1996 Olympics, though his loss in the semifinals was an outrageously bad call. As a pro, he's won world titles at 130, 135, 140, 147 and 154 pounds.

He has spoken of being rated the greatest fighter ever, and to do that, he'd have to beat the best opponent of his era. Without question, for Mayweather, that is Pacquiao.

To make the fight, though, Mayweather must also stay out of further legal trouble. He was paroled in August after serving just under two months of a six-month sentence for misdemeanor domestic violence. Part of the sentence was suspended, but he could be required by Las Vegas judge Melissa Saragosa to serve that time if he has another incident with the law.

Money not enough compensation for blast victims, NPA told said...

The New People's Army should do more than pay P5,000 to people injured in a grenade attack in Davao City early this month, the chairman of a government peace panel said Friday.

Alexander Padilla, chairman of the peace panel negotiating with the Communist Party of the Philippines-New People’s Army-National Democratic Front (CPP/NPA/NDF),
called the reported payment to around 50 victims a "stop-gap solution." He added the P5,000 indemnification "(clouds) the issue of violation of international humanitarian law and Philippine law."

Instead, the NPA should turn over the perpetrators to the government.

According to reports the distribution of payments was done by Exodus for Justice and Peace, which CPP-NPA-NDF tapped as third-party facilitator for the indemnification of the victims. EJP has representatives from religious groups, the academe, media, and civil society organizations.

NPA's Merardo Arce command has taken responsibility and has apologized for the grenade attack. It said that its attack was meant for an Armed Forces of the Philippines detachment in Paquibato, Davao City but that it had "erred in considering the circumstances, combat intelligence and all pertinent operational information in instigating the NPA action.”

"The NPA will take concrete measures to indemnify the victims consistent with the principles of revolutionary justice and the policies governing the New People’s Army and the revolutionary movement," it said in a statement on September 7.

But Padilla said "the demands of justice are predicated on a rule of law and cannot be met by one-off payments." He added the CPP-NPA-NDF's refusal to turn over the perpetrators to authorities "adds insult to injury." He said that the perpetrators would instead be subjected to revolutionary justice which "has been exposed as a sham by many, including United Nations Special Rapporteur Philip Alston in a report in 2008." He said the CPP-NPA-NDF's style of justice has no "regard to the rule of law including basic rights."

The grenade attack, which happened at a carnival in Paquibato, left 48 injured.

According to the Office of the Presidential Adviser on the Peace Process, formal peace negotiations between the government and the CPP-NPA-NDF have been stalled since 2004. There have been informal exploratory talks since then.

China urges Philippines to mend ties after row said...

Chinese leader-in-waiting Xi Jinping has told a visiting Philippine envoy that he hopes ties hurt by a territorial row can recover, state media said Saturday.

Vice President Xi told Philippine Interior Secretary Mar Roxas that tensions between the two countries had "eased" after a blow-up over a disputed island in the South China Sea, Xinhua news agency reported.

Trouble flared in April when vessels from the two countries became engaged in a stand-off over the rocky outcrop known as Scarborough Shoal. Both sides later agreed to withdraw their boats, defusing some of the tension.

"I hope this (situation) will not appear again and again, allowing bilateral relations to return to the track of normal development," Xinhua quoted Xi as telling the special envoy of Philippine President Benigno Aquino at a trade fair in southern China on Friday.

"China-Philippine relations have encountered some difficulties. However, through effective communication between the two sides, the situation has already eased," Xi said.

In Manila, a government statement quoted Roxas as saying the two had had "a frank and candid exchange of views".

It said both sides "expressed their desire to resolve outstanding issues while moving forward with their bilateral relations".

"(The) discussions were constructive and the talks were conducted in a cordial atmosphere," Roxas added.

The talks in the city of Nanning came after Aquino failed to secure a meeting with Chinese President Hu Jintao at the Asia-Pacific Economic Cooperation (APEC) meeting in Russia earlier this month.

Xi is widely expected to succeed Hu as leader of China's ruling Communist Party at an upcoming party meeting, then take over as president in March next year.

China claims sovereignty over nearly all of the South China Sea, which is believed to hold vast amounts of oil and gas, is a rich fishing ground and is home to shipping lanes vital to global trade.

But the Philippines, Brunei, Malaysia, Vietnam and Taiwan also have claims to parts of the sea, some of them overlapping.

China is also locked in a territorial dispute with Japan over disputed islands in the East China Sea, which Japan administers and calls Senkaku but China claims and knows as Diaoyu.

Why Pangilinan is cutting ties with Ateneo said...

The Ateneo de Manila University administration's religious stand on controversial issues, particularly the Reproductive Health (RH) Bill and mining, seem to have soured the school's ties with its top supporter.

"[I] believe we have come to the irretrievable point where it is best and appropriate to draw the line in the sand, to conclude that we have little or no common interest..." media and telecommunications magnate Manny Pangilinan said in a letter to Ateneo President Jose Ramon Villarin.

"[I]’d look like a fool helping an institution which opposes my conviction diametrically and unequivocally," Pangilinan said.

The chair of the TV 5 Network, Philippine LONG Distance Telephone Co. and Philex Mining Corp., among other firms, was reacting to an Ateneo position paper dubbed the "Jesuit Paper."

The letter was posted online "with the author's permission" by Denis Lucindo, Philex vice president for business development.

One of the "logical consequences" of the falling-out, Pangilinan said, is that he and Ateneo can pursue their advocacies "freely without having to be sensitive with regard each other's feelings."

Another is his "complete and total disengagement from the Ateneo," something which he said he welcomes "with some relief at this stage."

This, as Pangilinan noted two previous "gruesome incidents" which dented his relationship with his alma mater.

These are accusations that his speech before Ateneo graduates in 2010 was copied from speeches of Hollywood actors plagiarism and his recent mining confrontation with business rival Gina Lopez.

Pangilinan also highlighted his "major concerns" about the "Jesuit paper."

"I do not agree with some of the CBCP’s pronouncements, including its recent stance on the RH Bill," Pangilinan said.

"At times, I believe the CBCP has taken positions contrary to the interest of our country," he added.

Pangilinan's statement comes after some members of the Ateneo faculty clashed with an administration statement opposing the RH bill in Congress.

Pangilinan also stessed the value of mining for the country's economic development.

"For the Church to say otherwise contradicts a very basic document of our people and frustrates the people’s constitutional will, values, and preference--plus the right to improve economic welfare..." Pangilinan told Villarin.

He also hit the "Jesuit paper" for suggesting that "a particular business is per se evil" if its relations with the government give rise to corrupt practices or other problems.

"It is man's frailty--Filipino frailty to be exact--that should be blamed, not the business," Pangilinan said.

While noting that "good mining practices" abound, he added: "[T]he Filipino’s failure to manage well is shown in almost all facets of our lives--poor airports, poor sewerage, unclean air, mediocre economic growth."

"The list is long. Our preponderant task as a people is simply to do better--to strive for excellence. Isn't that the Ateneo motto?" Pangilinan said.

He added that the "Jesuit Paper" shows "EO 79 (Executive Order 79, on mining) and the Implementing Rules and Regulations."

"In any event, to the extent that the terms of the Paper are non-negotiable, and do run contrary to what our laws and Constitution say and to what I believe in... this makes it difficult for my conscience to accept the Paper as currently drafted," Pangilinan said.

SEOUL (Reuters) - Samsung Electronics Co plans to add Apple Inc's iPhone 5 to existing patent lawsuits against its U.S. rival, stepping up its legal challenge to Apple as the two smartphone leaders seek to assert rights to key technologies.

The fresh legal step by the South Korean group comes as Apple booked orders for over 2 million iPhone 5s in the first 24 hours of its availability. The product is due to hit stores on Friday.

Samsung and Apple are locked in patent battle in 10 countries and the stakes are high as the two vie for top spot in the booming smartphone market.

Both companies are also raising marketing spending to promote their latest products ahead of the crucial year-end holiday season.

"Samsung anticipates that it will file, in the near future, a motion to amend its infringement contentions to add the iPhone 5 as an accused product," the company said in a U.S. court filing.

"Based on information currently available, Samsung expects that the iPhone 5 will infringe the asserted Samsung patents-in-suit in the same way as the other accused iPhone models."

Samsung said in a separate statement on Thursday: "Apple continues to take aggressive legal measures that will limit market competition.

"Under these circumstances, we have little choice but to take the steps necessary to protect our innovations and intellectual property rights."

Apple Korea reiterated its position that it was the victim of copying, not vice versa.

"At Apple, we value originality and innovation ... We make these products to delight our customers, not for our competitors to flagrantly copy."

Apple scored a legal victory over Samsung in late August when a U.S. jury found the Korean firm had copied critical features of the iPhone and awarded the U.S. firm $1.05 billion in damages.

The jury also found that Apple did not infringe any of Samsung's asserted patents. Samsung has since vowed it would continue to fight.

Apple's victory was also a blow to Google Inc, whose Android software powers the Samsung products that were found to infringe Apple patents.

Samsung, the biggest Android phone maker, received a second U.S. legal setback last week when a judge at the International Trade Commission said in a preliminary ruling that Apple did not violate patents owned by Samsung.

The Korean firm was the world's top smartphone maker in the second quarter of 2012, shipping more than 50 million phones, nearly double the Apple's 26 million iPhone shipments.

Facebook switches off facial recognition tool said...

Facebook said Friday it had switched off the facial-recognition tool that prompts users to "tag" photographs uploaded to its website following a privacy investigation.

The feature was identified by regulators as one of the main privacy threats posed by the social networking site.

Ireland's Data Protection Commissioner (DPC), Billy Hawkes, who launched the probe because Facebook's European operations are based in Ireland, said he was happy that the site had agreed to remove the tool in Europe by October 15.

New users are already unable to access it.

Hawkes said: "I am satisfied that the review has demonstrated a clear and ongoing commitment on the part of FB-I to comply with its data protection responsibilities."

He added: "By doing so it is sending a clear signal of its wish to demonstrate its commitment to best practice in data protection compliance."

Facebook said in a statement: "In light of discussions with our regulator in Ireland, we have agreed to suspend the Tag Suggest feature in Europe."

It said it would work with the Irish authorities "on the appropriate way to obtain user consent for this kind of technology under European rules".

Facebook was keen to encourage members to "tag" their friends in photographs because it ensures they are shared more widely, but it has been a controversial addition to the site.

Europe-versus-Facebook, an Austrian campaign group that has been fighting for clearer privacy policies on Facebook and already took its complaints to the DPC last year, welcomed Friday's ruling.

This was "a very surprising decision of the Irish authority" and it "sounds like a big victory for users," the group said on its website.

"It looks like we might soon be able to drop our first complaint," it added.

Leni Robredo eyes Congress seat said...

Maria Leonor "Leni" Robredo, widow of former Interior Secretary Jesse Robredo, has answered clamors for her to follow in her late husband's footsteps.

Robredo filed her certificate of candidacy for Camarines Sur third district representative at the local Commission on Elections office, reports on Friday said.

"[K]ami po ng mga anak ko nagulat sa mga pangyayari. Para kaming naitulak sa isang corner na wala kaming choice. Sana divine intervention na yun (My children and I were surprised by this turn of events. It's as if we were caught in a corner and we had no choice. I hope that was divine intervention)," Robredo said in a press briefing broadcast over the radio.

Supporters flocked to their Naga City home Friday morning, most of them tearful as they urged her to seek Rep. Luis Villafuerte Sr.'s seat in Congress, she added.

Villafuerte is serving out his last term and will be running for Camarines Sur governor against his grandson Miguel Villafuerte.

"Parang leap of faith na... Kung hindi naman po nagkaroon ng gulo, talaga naman pong hindi ako kandidato (I consider it a leap of faith... Without the confusion, I really wouldn't be running)," the lawyer said.

Reports earlier floated the possibility that Robredo will be pushed to run under the admistration coalition's Senate slate congressional following the highly publicized death of her husband.

Jesse Robredo died in a plane crash off the island of Masbate Aug. 18, along with two pilots.

When she finally decided to run, Robredo she was shocked that supporters have already prepared her certificate of candidacy.

"Pagdating ko, magta-thumbmark na lang ako (When I arrived, I only had to place my thumbmark)," Robredo said.

Robredo also admitted that she was not able to think her decision through thoroughly.

"Talagang binase ko na lang siya sa faith ng supporters namin (I only based it on our supporters' faith)," she said.

"Sana mas maraming oras po para pag-isipan ito (I hope I had more time to think this through)," she said.

Earlier Friday, the Robredo widow posted via her Twitter account: "Can't believe this is happening."

Bam urges PNoy against libel provision in Cybercrime law said...

Liberal Party (LP) senatorial bet Paolo Benigno "Bam" Aquino IV talked to his first cousin about his opposition on some controversial provisions of the new law against cybercrime.

Aquino disclosed he is trying to convince his close relative, President Benigno "Noynoy" Aquino III, to remove the criminal liability of libel committed against the Cybercrime Prevention Act.

"I told him my position at one point," Aquino told reporters after filing his certificate of candidacy on its last day at the Commission on Elections (Comelec) main office in Manila on Friday morning.

The young Aquino disclosed telling the president about his thoughts on anti-cybercrime law, saying commission of libel should only have civil liability.

Aquino, who expressed his pride in sharing the same last name with the president, was optimistic that lawmakers in both houses of Congress will be able to repeal the new law as soon as possible.

But the young Aquino refused to reveal the reaction of President Aquino, who signed the bill ensuring cyberspace security into law in September.

"I just mentioned it to him way before calls and petitions were made about it came," the senatorial aspirant clarified.

Saying that he understands the social networking culture of the young generation, the 35-year old Aquino expressed optimism to influence the aging members of Senate about new expressions of speech.

But while senators wait for the resumption of Congress to discuss amendments on the controversial law on October 8, House Speaker Feliciano "Sonny" Belmonte Jr. said he would not prioritize discussions on the matter in the House of Representatives.

Instead, Belmonte asked online communities to give the new law a chance, emphasizing the need of the government to realize the legislation's strength and weaknesses first by its full implementation.

“Let’s give it (law) a chance. It’s really easy to change it if there
is a real necessity to do so. But without even waiting for the
implementing rules and regulations or IRR, it cannot be," Belmonte said.

"We have not seen its flaws and yet we want to change it right away,"
Belmonte told reporters in a press conference on Thursday night.

Meanwhile, reelectionist Senator Alan Peter Cayetano, who would have against the libel provision in Cybercrime Prevetntion Bill, defended the senators who admitted oversight that led to the passage of the law.

Cayetano, who was not around when the bi-cameral conference committee voted on the legislation's approval, promised to file a series of amendments not only on anti-cybercrime law but on existing Libel law.

Cybercrime Law creators lament too much ‘insertions’ said...

Apart from the libel provision, the law is also being criticized for giving the Department of Justice (DOJ) the power to act on Internet-related activities without a warrant; the creation of another investigating body, the Cybercrime Investigation and Coordinating Center (CICC); and the incorporation of provisions from Revised Penal Code in the review and prosecution of cases.
The PH-CERT is a private organization that was tasked to draft the original Anti-Cybercrime Law. Its executives, led by its President Angelito Averia, and Director Albert dela Cruz, released their official statement on October 3, two weeks after the Anti-Cybercrime Law was passed.
In an interview, Averia said that they were made aware of the insertions of the provisions on libel, only after period of amendments in January. As for the inclusions of the Revised Penal Code and the take down provisions that were proposed by other parties, these were discussed with the resource persons in separate meetings before January 2012. Proponents of these provisions were requested by the Congressional Commission on Science, Technology and Engineering (COMSTE) for their proposed amendments via position papers.
The COMSTE is headed by Senator Edgardo Angara, one of the chief supporters of the Anti-Cybercrime Law.
Averia said that they tried to discuss those provisions with those who made the insertions. Unfortunately, the agenda was already set.
He insisted that PH-CERT’s goals were largely to follow the international guidelines set in the Budapest Convention, which is the globally recognized principle that defines what constitutes cybercrime, such as hacking, online stalking, online sex, and harassment, among others.
The Philippines is among the countries invited to become signatory to the Budapest Convention.
“The draft that we were preparing for 11 years saw some changes in the hands of legislators that we didn’t anticipate. As PH-CERT, we spoke about the possible implications of these insertions. Ours was only to follow consistency based on the Budapest Convention,” Averia said.
On the other hand, he clarified that the libel provision was indeed pushed by Senator Vicente Sotto III in January, belying accusations that Sotto put it to get back at his critics online. Sotto was targeted for alleged plagiarism of his speech about another proposed law being deliberated, the Reproductive Health Bill.
Averia also said that the original draft of the Anti-Cybercrime Law didn’t have provisions for a cybercrime coordinating body, nor did it give power to the DOJ. Instead, the original draft still gave law enforcement powers to the National Bureau of Investigation (NBI) and the Philippine National Police Criminal Investigation and Detection Group (PNP-CIDG).
“They [NBI AND PNP] are supposed to do the investigation because it is their mandate. They already have a network of enforcement agencies abroad. Having another body is superfluous. It just creates another bureaucracy,” Averia said, referring to the CICC.
With the law already being implemented, Averia said that the PH-CERT will be pushing for amendments of the current law. He said that the group believes there are provisions in the Anti-Cybercrime Law that would benefit the Philippines, He said the group still hopes that the implementing rules and regulations (IRR) will ensure that the concerns referring to the inclusions are cleared out.
“There’s always real danger of abuse especially if the definitions in the law are not satisfied. There should be necessary safeguards to prevent abuse by anyone and the IRR should be very clear with what is justifiable,” Averia said.

Chiz finally admits relationship with Heart said...

Senator Francis “Chiz” Escudero finally admits that actress Heart Evangelista is his girlfriend.

During his last day as a special “Kris TV” guest co-host, the senator said he and Heart are already a couple, after much prodding from host Kris Aquino.

“We’re seeing each other. As far as I know, she’s not seeing someone else and neither am I,” Chiz said.

To make his statement clear, Kris further asked, “Is Heart Evangelista your girlfriend?”

Chiz then replied, “I would like to think so, yes.”

The senator clarifies that he did not look for love but his new relationship came unexpectedly.

“Hindi ako naghanap. Dumating lang, siguro mas maganda yung ganoon. Kasi may kasabihan na kapag mas lalo mong hinanap, mas lalo mong hindi makikita. At kung hihintayin mong maging handa ka, hindi ring mangyayari iyon. Dumating na lang, hindi inaasahan,” Chiz said.

Chiz finds his relationship with Heart “very refreshing” because they come from different worlds - politics and showbiz. It was Senator Miriam Santiago who introduced them to each other.

“Walang kinalaman sa pinanggalingan ko, sa mundo kong ginagalawan ko ngayon, that’s very refreshing. Mahirap yung kakilala mo lahat. Maganda yung bago, walang kinalaman sa nakaraan mo, wala ka ring kinalaman sa nakaraan niya,” he said.

Chiz also sees Heart as his “sanctuary.”

“Walang kinalaman yung mundo niya sa mundo ko. Kaya kapag tuwing nagkikita kami, parang sanctuary siya. Hindi niya kailangang awayin yung mga umaway sa iyo, hiwalay iyon,” he said.

In a separate interview with Heart, she did not say anything about their relationship, but she said good things about the senator.

“Nakakatawa siya. He’s a very funny person. Pag dating sa mga serious matters, seryoso siya. Pero kapag walang nakatingin, normal siyang tao, very down-to-earth, cowboy,” Heart said.

(Updated 11:31 p.m., 14 November 2012) In the old days, an impatient commuter losing her cool and berating a security guard would only have attracted a small crowd.

In the technology age, the crowd for such a mundane incident can be a large global audience of social media users and TV viewers.

A video of a passenger scolding a guard at the Light Railway Transit (LRT) Santolan station went viral on Facebook Tuesday night, getting more than 68,000 shares and 17,000 comments, and aired on TV networks.

The hashtag #AMALAYER, which came from the passenger's pronunciation of "I'm a liar," even trended on Twitter, both worldwide and in the Philippines.

In a video sent by YouScooper Gregory Paulo Llamoso, passenger Paula Jamie Salvosa was seen giving a female security guard a tongue-lashing. “I’m a liar? I’m a liar?” Salvosa yelled.

Reached by GMA News, Salvosa said she is willing to resolve the issue with the security guard, though it was the lady guard who raised her voice initially.

"Sabi n'ya sa 'kin, sumigaw, 'Miss, anong problema mo?' Sabi ko sa kanya, you are my problem!" she said.

Salvosa added that the guard, identified as Sharon Mae Casinas, grabbed her arm. "Sabi ko, bakit? You have no right to drag me! Nagagalit ako kasi she grabbed me!"

Salvosa said she would not have reacted that way if the guard had treated her well.

For her part, Casinas said she asked the woman to put her bag though the X-ray machine for proper inspection. However, Salvosa began raising her voice.

Casinas, on the other hand, said she remained calm despite the humiliation. "Nagkulong po [ako] sa kwarto sa sobrang kahihiyan," she added.

Meanwhile, Salvosa said she is a victim of cyberbullying. She also denied that she owns the Twitter account @paulaharlow, as she has already deactivated her Twitter and Facebook accounts.

"I want to be an example na may karapatan naman tayo. Cyberbullying ito," she said.

Side comments and facial expressions In a news release, the Rail Transit Authority (LRTA) explained that Casinas was merely performing her duties as she requested Salvosa to put her bag through an x-ray machine.

But the latter somehow missed the procedure and hurriedly tried to enter the station.

LRTA Officer-in-Charge Emerson L. Benitez said that their security personnel are instructed to strictly implement the “No inspection, No entry” policy.

The rule ensures the safety and security of passengers. Benitez admitted that this may inconvenience passengers.

Therefore, security personnel have been instructed to “refrain from making side comments and facial expressions that may be offensive to our passengers.”

Also, all LRT security personnel have undergone a seminar on Quality Customer Service Delivery before their deployment and are given refresher courses semi-annually.

“Ms. Casinas displayed the right attitude expected of a security guard,” said the LRTA, “that is, to be courteous and tolerant in spite of the embarrassment.”

A little patience, please, the Light Rail Transit (LRT) Authority seemed to say, as it asked passengers to bear with procedures to ensure security and safety of passengers.

This, as a video of an encounter between an irate passenger and a security guard named Sharon Mae Casinas at the train's Santolan Station has drawn mixed reaction from Pinoys online.

"Based on investigation LG (lady guard) Casinas requested the female passenger to put her bag at the conveyor of the x-ray machine for scanning but the latter somehow missed the procedure and hurriedly entered the station," the LRTA said in a statement late Wednesday.

LRTA security personnel are instructed to strictly implement the "No inspection, no entry" policy to ensure the safety of passengers, LRTA officer-in-charge Emerson Benitez said in a statement.

The LRTA statement said Casinas "apologizes for whatever action that she had committed deemed offensive by the passenger concerned."

After giving a lecture at the Far Eastern University on Thursday, Santiago declined proposals from student leaders for her to join the presidential race in 2016.

“(I am) not interested in running for president,” Santiago told around 1,000 students who asked her to run for president with Senator Ferdinand “Bongbong” Marcos Jr. as her running mate.

“After winning the elections for new judges of the International Criminal Court (ICC), I am bound to report for work at The Netherlands to assume office,” she explained.

Santiago was elected as a judge in ICC after receiving 79 out of 104 valid votes during the 10th session of the Assembly of States Parties in New York on December 2011.

Santiago told students she want to work for nine years in international law so she may be able to practice what she learned in University of Michigan, where she earned a doctorate on juridical science.

Her media relations officer Tom Tolibas confirmed she is willing to resign from her post as a member of the Upper House even before her term ends in 2016.

“As of now, we have not yet received any word as to when she can assume post. We have to wait until there is a new case for her to handle (in ICC),” Tolibas explained.

The ICC is an independent international body and is the first permanent international court that decides on crimes against humanity.

However, Santiago advised students to look out for various distortions in choosing candidates for the upcoming senatorial elections.

She explained the lack of education among voters and candidates actually distorts the so-called voter participation in elections.

"Elections are distorted because under our system, the successful candidate might be the choice of only a minority,” Santiago said.

“This was what happened when the people and I were robbed of the presidency in 1992. The person who claimed that he won the presidential election was only a plurality president," she noted.

A naked man brought parts of central London to a standstill on Friday after he installed himself on a statue near Prime Minister David Cameron's office for nearly three hours.

He braved the November cold and gawking crowds to straddle the monument to Prince George, a 19th century military chief and one-time Duke of Cambridge, adopting various poses including balancing precariously on the prince's head.

Police were called to the statue on Whitehall, the street on which many government offices including Cameron's Downing Street residence are located, after reports that a man had climbed up and might have had a knife.

From midday to about 3pm, police cordoned off the area as they tried to persuade him to come down. Finally they got him into a police van, where he was detained under the Mental Health Act, police said.

Camacho's mother says life support to end said...

The mother of Hector "Macho" Camacho, the Puerto Rican ring great declared brain dead after being shot, said he will be taken off life support, a move the ex-champion's eldest son opposes.

Camacho's mother, Maria Matias, said in a press conference that she has accepted the doctors' verdict rendered Thursday that the three-time world champion was clinically brain-dead and could not recover.

She said the family would wait until Saturday, so that all of Camacho's children will have a chance to say goodbye.

But Camacho's eldest son, Hector Camacho jnr, insisted Friday night that "the fight is not over until the final round," and that he believed Camacho should stay connected to the respirator keeping him alive.

"Doctors make mistakes. Men make mistakes. God does not make mistakes," Camacho jnr said after visiting his father again at Centro Medico hospital in Rio Piedras, Puerto Rico. "He is a fighter and the fight will continue until the end."

However, Camacho jnr acknowledged that the final decision would belong to Matias - "my grandmother, the woman who gave birth to my papa."

Flanked by friends and family members, Matias told reporters that on Saturday she would do the only thing left she could do for her son.

"I lost my son three days ago," she said in a firm and determined voice.

"He's alive only because of a machine. My son is not alive. My son is only alive for the people who love him."

She said that she had been told by one friend who had visited Camacho in hospital that he remained alive, that his legs had moved.

"But in reality, it's electricity," she said. "The reality is that my son has gone."

Dr Ernesto Torres said Thursday morning that Camacho showed no sign of brain activity.

The 50-year-old ex-fighter was shot on Tuesday while in a car in San Juan outside a liquor store. The boxer's driver, Alberto Mojica Moreno, 49, was killed in the shooting.

It was not immediately clear if they were deliberately targeted or simply caught up in a random act of violence. The bullet damaged three arteries in Camacho's neck, crippling the flow of blood to his brain.

Camacho was one of the most colorful boxers of the 1980s, winning world titles at super lightweight, lightweight and light welterweight.

With a career record of 79-6-3 with 38 knockouts, he took on all comers, including big names Oscar De La Hoya, Julio Cesar Chavez, Sugar Ray Leonard, Felix Trinidad, Ray Mancini and Greg Haugen.

But battles with drugs and alcohol led to numerous brushes with the law outside the ring.

Earlier this year, US police charged him with child abuse for allegedly slamming his son into a floor at his ex-wife's home in Florida.

Ismael Leandry, a friend and former manager and a key figure in Camacho's ring career, told AFP that Puerto Rico's secretary of recreation and sport, Henry Neumann, along with the boxing commission, were already preparing a tribute to the fighter.

While a public funeral could be held in Puerto Rico, some in the family have expressed a desire to see him buried in New York, where he spent much of his life.

This can be tricky. Your common friends can be asked to play unbiased mediators in your fight. Here, two things can happen. One, they successfully help you sort out issues. Two, they end up taking sides and you are now not only left with a dying relationship but also with a dying friendship.
4. Assume responsibility

Once you have thought things through and are communicating with your partner, you need to start assuming responsibility; responsibility for the relationship, for what went wrong, for your role in allowing things to get out of hand. Once you own up to your errors, you will feel slightly less burdened and will begin to see things with the right perspective.
5. Forgive and comprise

If you have accepted your errors, then you understand the importance and power of forgiveness. You must forgive each other if the relationship has to survive the storm. Forgiveness is not about forgetting what happened, but about accepting the reality of the situation and deciding to rise above it. Also, without compromise you will head nowhere in life. So, why not start with a relationship that really matters to you?

Philippine massacre clan jostling for power again said...

Dozens of members of a clan whose leaders are on trial for the Philippines' worst political massacre are candidates in 2013 elections, some for the president's party, media and rights groups said Friday.

The revelations sparked outrage on the three-year anniversary of the massacre, in which 58 people died, with critics saying the Ampatuan family's enduring political influence underlined the country's "culture of impunity".

"That some clan members are running under the banner of President (Benigno) Aquino's party is a serious cause for concern because it imparts a damaging message that impunity is alive and well," Human Rights Watch's Carlos Conde told AFP.

Leaders of the clan, then allied to Aquino's predecessor, Gloria Arroyo, are accused of carrying out the massacre to stop a local rival from filing his candidacy for Maguindanao province governor in 2010 elections.

Andal Ampatuan Snr, the patriarch and then governor of the province, plus four of his sons, are on trial, accused of planning or participating in the massacre. They deny the charges.

Eighty-two people in total are on trial, many of whom were allegedly members of the Ampatuans' private army that helped to consolidate the family's almost complete control of the province over the previous decade.

The victims included 32 media workers who were travelling in a convoy to report on the opposition candidate's attempt to file election papers. The Ampatuans and their gunmen allegedly stopped the convoy and shot everyone dead.

In the aftermath of the massacre, Arroyo was forced to cut political ties with the family, and its power base in Maguindanao, a Muslim-populated province plagued by insurrection and other violence, appeared to have been diminished.

But 72 members of the clan are running again as candidates in next year's elections, including nine for Aquino's Liberal Party, said the National Union of Journalists of the Philippines.

They are representing mostly local level positions in Maguindanao, said a joint statement by the union and six other Philippine media organisations that expressed deep anger.

"Even as fear of reprisals continue to haunt witnesses and plaintiffs in the case, the government of Mr. Aquino and other major political parties in the country have embraced the Ampatuan clan," the groups said.

The Philippine Daily Inquirer newspaper also wrote in an editorial Friday: "How can the political parties not know that support for Ampatuan candidates feeds the very impunity that led to the massacre?"

In the Philippines, powerful politicians and other members of the elite classes often commit crimes without any fear of punishment. Aquino has vowed to tackle this culture.

Aquino's spokesman, Edwin Lacierda, confirmed the ruling Liberal party had recruited some Ampatuans, but defended the move saying they did not share the same "brand of politics" as the accused. He did not say who had been recruited.

The main opposition United Nationalist Alliance, led by Vice President Jejomar Binay, also confirmed some Ampatuans were running in its coalition but said they had not been implicated in the massacre.

"What's the big fuss?" coalition spokesman Jose Bautista said to AFP.

"Should each and every Ampatuan be penalised for the murders?"

Meanwhile, the trial drags on with no signs of an end. Lawyers have said it could take years, or even decades, for the proceedings to conclude amid the Philippines' notoriously overwhelmed justice system.

Three witnesses for the prosecution have been killed over the past three years.

Ericsson sues Samsung for patent infringement said...

STOCKHOLM (Reuters) - Ericsson, the world's biggest telecom network equipment maker, said it was suing Samsung Electronics Co for patent infringement after two years of talks failed to yield a license agreement.

Sweden's Ericsson, which reckons more than 40 percent of the world's mobile traffic passes through its networks, filed a lawsuit in the United States saying Samsung had refused to sign a license to use technology on terms it referred to as fair, reasonable and non-discriminatory (FRAND).

"Ericsson has tried long and hard to amicably come to an agreement with Samsung and sign a license agreement on FRAND terms. We have turned to litigation as a last resort," Kasim Alfalahi, chief intellectual property officer at Ericsson said in a statement on Tuesday.

Alfalahi noted Ericsson has over 30,000 patents and more than 100 license agreements with major players in the industry.

A surge in smartphone and tablet computer sales has driven a switch in traffic on telecoms networks from mainly voice calls to video and music, which take up more capacity.

But although data traffic is surging - smartphone subscriptions alone are expected to rise to 3.3 billion by 2018 according to Ericsson's own figures - operators are finding it hard to get customers to pay much extra, squeezing their profits.

With Ericsson suffering a big drop in sales at its network unit - down 17 percent in the third quarter - it is increasingly turning to the courts to maintain its patent income, part of a wider trend where big technology names are fiercely protecting their intellectual property as global sales of tablets and smartphones boom.

One lawsuit by Apple relating to patents resulted in a $1.05 billion jury verdict against Samsung, the world's largest cell phone and television maker, in August.

An Ericsson spokesman declined to comment on the size of its lawsuit.

Samsung said it will "take all necessary legal measures to protect against Ericsson's excessive claims."

"Samsung has faithfully committed itself to conducting fair and reasonable negotiations with Ericsson over the past two years, but Ericsson has demanded prohibitively higher royalty rates to renew the same patent portfolio," the South Korean company said.

FRAND

Samsung is also embroiled in a legal war with Apple in more than 20 disputes in 10 countries, with Apple alleging various Samsung smartphone and tablet products infringed its patents.

"Ericsson now has plenty of material from Samsung's litigations with Apple to quote in support of high FRAND royalty rates and sales bans," said Florian Mueller, blogger and patent expert who has advised Microsoft and Oracle in the past.

The Ericsson dispute concerns patented technology the Swedish firm says is essential to several telecommunications and networking standards used by Samsung's products as well as other patented inventions that are frequently implemented in wireless and consumer electronics products, the company said.

Philippine jigsaw puzzler sets Guinness record said...

From Mona Lisa to Mickey Mouse, a Philippine guesthouse owner has pieced together over a thousand jigsaw puzzles, and on Thursday her collection was officially declared the world's largest.

"It was just a hobby at first. It takes away my stress," Gina Gil Lacuna, 61, told AFP as she was awarded her certificate of recognition by Guinness World Records.

But the pastime, which she took up 26 years ago, turned into an obsession that has seen her collect a total of 1,028 different puzzles, framed wall to wall at her two-story bed and breakfast.

The puzzles form pictures of religious figures, animals and landscapes, and even Philippine President Benigno Aquino, with the largest containing over 18,000 pieces.

Her guesthouse, in the resort city of Tagaytay just outside the Philippine capital, is known as "Puzzle Mansion".

"She is very disciplined lady. Every day, she spends three or four hours doing puzzles," said Guinness adjudicator Seyda Subasi Gemici, adding that all the jigsaws had to be different and with all the pieces complete to count towards the total.

Her collection surpasses the previous record of 238 puzzles held by a Brazilian woman, Guinness officials said, and she is already working on 20 new puzzles so she can retain her title.

Anne Curtis: I won’t have my moles removed said...

Now that she can heave a sigh of relief after Dr. Vicki Belo declared that her moles are non-cancerous, Anne Curtis said she’ll never have any of her "beauty marks" removed.

“I love my moles! Basta hindi siya cause of any harm or they’re not a threat to my health, I won’t take them out. They’re part of me and it would break my heart to have them removed,” Anne said at the Christmas party of Greenwich, where she is one of the pasta girls along with Solenn Heussaff and Kelly Misa.

The Kapamilya star hopes her decision to ask Dr. Belo to check her moles will promote social awareness about the need to have one’s moles checked.

Anne recalls that she decided to have her moles – two on her face and one on her chest – examined after noticing that those on her face were growing bigger. Anne explained that she was concerned because she knows some moles can be cancerous.

“At least, na-klaro na,” Anne added. “Sabi ni Dra. Belo, yung mga buhay hindi masyadong (nakakatakot). Yung mga flat daw na nagbabago ng shape na akala mo mga buhay ang nakakatakot.”

Anne is looking forward to spending a white Christmas for the first time with her family.

“Aalis sila (her family members) first week of December. Magkikita na lang kami sa States kasi kailangan ko pa mag-Showtime.”

Sen. Santiago files 'Cybercrime Law v2.0' said...

To address the perceived shortcomings of Republic Act No. 10175 (RA 10175) or the Philippine Cybercrime Law, Senator Miriam Defensor-Santiago has filed a bill that she calls "Cybercrime Law version 2.0."

Senate Bill 3327 (SB 3327), also known as the Magna Carta for Philippine Internet Freedom (MCPIF), aims to protect the rights and freedoms of Filipino netizens, while acting on cybercrimes.

“While it is important to crack down on criminal activities on the internet, protecting constitutional rights like free expression, privacy, and due process should hold a higher place in crafting laws,” said Santiago in a statement.

The senator also pointed out that, unlike RA 10175, the new bill specifically upholds freedom of expression online.

“The MCPIF does not suffer from overbreadth and vagueness in its provisions on libel, unlike the law it tries to replace. In fact, it treats libel as a civil liability rather than a criminal act, which is a step forward in the move to decriminalize libel,” Santiago said.

Other features of MCPIF according to Santiago's statement are:

-ensures due process by providing strict guidelines for any collection of any data, including the securing of warrants, obligating notification, and limiting seizure to data and excluding physical property mandates government agencies to provide security for the data they collect from citizens to ensure their right to privacy

-provides for court proceedings in cases where websites or networks are to be taken down

-prohibits censorship of content without a court order prohibits double jeopardy

-seeks to clarify the mandate and organization of the proposed Department of Information and Communications Technology (DICT) prepares the proposed DICT, law enforcement agencies, and the military with provisions for handling cybercrimes

-provides amendments to the AFP Modernization Act to ensure the country has weapons and defenses against cyberattacks by terrorists, violent non-state actors, and rogue or enemy nation-states

-mandates the Philippine National Police and the National Bureau of Investigation to combat cyberterrorism

Santiago also said that her bill aims to define other crimes which can be committed online.

“We need to recognize that child pornography, child abuse, and human trafficking can be committed through the internet, as much as hacking, piracy, and copyright infringement. We must define these evils in order for us to crush them,” the senator added.1

NEW YORK/LOS ANGELES (Reuters) - Lindsay Lohan on Thursday faced the possibility of being sent back to jail after a tumultuous 24 hours in which she was arrested in New York for assault, and charged in California with reckless driving and lying to police over a June car crash.

Lohan, 26, who has been to rehab, jail and court multiple times since a 2007 arrest for drunk driving and cocaine possession, is still on unsupervised probation in Los Angeles for a 2011 jewellery theft.

But prosecutors in Santa Monica, California, said in a statement on Thursday that the "Mean Girls" actress lied to police when she told them she was not at the wheel of her Porsche when it smashed into a truck on a busy highway in the summer.

They charged Lohan with three misdemeanour counts stemming from that collision, hours after the troubled starlet was arrested on suspicion of punching a woman in the face at a Manhattan nightclub.

Lohan's New York attorney Mark Heller said the actress was "a victim of someone trying to capture their 15 minutes of fame."

"From my initial investigation, I am completely confident that this case will be concluded favourably and that Lindsay will be completely exonerated," Heller said in a statement on the nightclub incident.

Frank Mateljan of the Los Angeles City Attorney's office, which handled the 2011 jewellery case, said prosecutors were still awaiting paperwork from New York and Santa Monica to determine if they will pursue a probation violation case against Lohan.

A Los Angeles judge told Lohan in March that she must obey all rules until 2014, and advised her to stop night-clubbing and focus on her work.

The two incidents came during a rough week for the former "Parent Trap" child star, who was once considered one of the most promising young actresses in Hollywood.

Her comeback performance on Sunday as screen legend Elizabeth Taylor in the TV movie "Liz & Dick," was panned by critics and watched by a disappointingly small U.S. TV audience of 3.5 million.

In New York, Lohan was briefly arrested shortly after 4 a.m. (0900 GMT) on Thursday on a third-degree misdemeanour assault charge against a 28-year-old woman, police said. The victim suffered minor injuries, New York Police Sergeant John Buthorn said.

Celebrity website TMZ.com said Lohan had been drinking heavily and lashed out in a stand-off over one of the members of British boy band The Wanted, who were also at the club after playing a concert in New York.

Lohan's recent visits to New York have featured run-ins with police and public spats over the last three months.

In October, police were called to the Long Island home of Lohan's mother, Dina, after a loud argument, though no arrests were made. In September, Lohan was arrested in Manhattan after a pedestrian told police her car had struck him in an alley, but charges were not filed.

Totoong mahirap mag-trabaho jan sa Stratvision kasi mas mahigpit talaga sila sa mga company rules and policies nila pero aminin man natin o hindi, natuto tayo sa kanila. Sa totoo lang nag-trabaho rin ako sa Stratvision at sa tingin ko eh medyo mahirap rin talaga mag-trabaho dyan dahil nga mas mahigpit sila compared dun sa ibang mga company.
